Australia Day. Invasion Day. Survival Day. To indigenous Australians it is a symbol of the ongoing war and genocide of aboriginal people. Outside Parliament House when it was announced "Hurley is going to be charged with manslaughter," people cheered. At last the prospect of a small amount of justice in the death in custody of Mulrunji Doomadgee in the Palm Island Lockup in North Queensland. Robbie Thorpe summed up the mood: "Instead of celebrating the invasion help us stop this war and we can have a real day to celebrate together. Inclusive of all people in this country..."

People started to gather outside the State Library at 11am. A mix of young and old. Black and white. After a few speeches the crowd, which had swelled to about 400 people, marched down Swanston and up Bourke street.

Chants included "Justice and Equality // Not racism or bigotry // Black and White in Unity // Howard doesn't speak for me // Howard doesn't speak for us // Howard doesn't speak for me" ; "Land Rights Now" ; "They call it suicide // We call it genocide" ; "Always was; Always will be // Aboriginal Land".

The march had a festive atmosphere, one which expressed determination to continue the resistance to the genocide of the last 218 years since the European invasion started, and the necessity for a treaty with the aboriginal nations.

At the Victorian Parliament House, where the first Federal Parliament sat until Canberra was chosen and built, more speeches were made, and ceremonial smoke wafted amid the crowd. Robbie Thorpe addressed the gathering in a strongly worded speech about the ongoing undeclared war and genocide of aboriginal people.

The crowd then marched to the 'Share the Spirit' Festival in the Treasury Gardens. Live music and festival stalls entertained people for much of the afternoon, with many people staying to picnic in the gardens.

The Share the Spirit Festival was put on by the Songlines aboriginal corporation with sponsorship by the Melbourne City Council. Kids danced to the music, or held orange balloons emblazoned with "3KND - Kool N Deadly", the local community aboriginal radio station that broadcasts 24 hous, 7 days a week on the AM band at the 1503 frequency.
